Due to the significant experience that we bring to the table, applications that we are involved in are often approved. Where applications are refused however, we are happy to support appellants with the Appeals Process. We have contributed to the success of a variety of appeals through Written Representations and by acting as Expert Witnesses at Hearings and Inquiries. Ed has also acted in Court where his case was successful.

Beth recently acted as an Expert Witness during an Inquiry in Mid-Suffolk. The proposal was for outline permission for 150 dwellings on a greenfield site on the outskirts of the settlement of Eye. Beth was acting for the applicant and found that no harm to heritage significance would ensue from the proposal and that some benefit to Aesthetic Fortuitous Value would result from the enhanced urban edge and associated landscaping. The Inspector agreed with Beth’s testimony and found that there would be no harm to Heritage Significance as a result of the proposed scheme.

 

appeal at Church Fenton, Selby

We have recently been commissioned by to act as Expert Witness for an appeal at Church Fenton in Selby. We are currently producing the Proof of Evidence to support a scheme for fifty houses within the setting of a Grade I listed church.  

 

Guisborough Conservation Area - residential care home

We were asked to represent the owners of a residential care home located in Guisborough Conservation Area in Redcar and Cleveland. The Council had refused consent for two new dwellings within a disused, Victorian, kitchen garden belonging to the care home. We submitted an Appeal Statement through the Written Representations appeals process and the inspector upheld our appeal, granting permission for the dwellings.

We have recently submitted an Appeal Statement through the Written Representations process for a major residential development within Pendle Borough. We are still awaiting the Inspector’s report.
